1. Agreement:
  1. These terms and conditions (Terms) and our Website Terms of Use at http://www.MegaHorse.net.au/Terms-Of-Use.html , Privacy Policy at http://www.MegaHorse.net.au/Privacy-Policy.html and constitutes the agreement between the Entrant (Entrant) and Mega Horse (the Agreement) in relation to your use of the website at www.MegaHorse.net.au (Website) and your participation in the Annual “Mega" Mega Horse Competition (Competition).

2. Acceptance of Terms:

  1. By participating in this Competition, each Entrant fully and unconditionally agrees to and accepts these Terms and the decisions of the Promoter.
  2. The Promoter's decision is final and binding, and no correspondence will be entered into.
  3. The Promoter reserves the right to change these Terms at any time.

3. The Competition:

  1. The competition consists of a national random Draw and each entry must be made on an official Competition entry form (Entry Form) and must be accompanied by proof of purchase of a Mega Horse horse supplement purchased from an approved Mega Horse stockist (Stockist) during the approved dates of the competition.
  2. The competition commences on 13th December, 2008 at 9am (EST) and closes at 3pm (EST) on 11th April, 2009.
  3. All contact information on the Entry Form is required including full name, telephone number, postal address and a valid email address.
  4. Entrants must also explain in 100 words or less why they like Mega Horse horse supplements.
  5. False, incorrect or incomplete registration information will deem the entry invalid, making that person ineligible to enter the Competition and to win any prizes.

4. Eligibility:

  1. Entry is open to residents of Australia who are 18 years of age or older except employees and Stockists of Mega Horse and their agencies or any member of their immediate family.
  2. Children under the age of 18 must have a parent or guardian's permission to enter.

5. Entries:

  1. Entrants are required to purchase a minimum of one (1) 10kg Bucket of Mega Horse horse supplement for one (1) entry into the draw unless:
       i.   Entrants purchase a 25kg Bag in which case they are entitled to fill out and submit three (3) official entry forms into the draw.
       ii.   Entrants purchase a 40kg Bag in which case they are entitled to fill out and submit five (5) official entry forms into the draw.
  2. There is no limit to the number of entries a Entrant may enter in the Competition, providing proof of purchase for each entry can be verified, and each product has being purchased from an authorised Stockist of Mega Horse, and the Entry Form is delivered to the Promoter between the official Competition dates.
  3. An entrant may enter the Draw by one of the following methods:
       i.   Download, print and complete the official entry form on the website at www.MegaHorse.net.au and post the entry form via Australia Post, along with proof of purchase, to the promoter so as to be received by 5pm on Thursday, 9th April, 2009.
       ii.   Complete the official entry form provided by approved Mega Horse stockists and post the entry form via Australia Post with proof of purchase to the promoter so as to be received by 5pm on Thursday, 9th April, 2009.
       iii.   Complete the official entry form provided by approved Mega Horse stockists and submit in person, with proof of purchase, to the promoter at the draw venue by 3pm on Saturday, 11th April, 2009.

6. Lost Entries:

  1. No responsibility is accepted by the Promoter for any late, lost or misdirected entries.
  2. Any costs associated with accessing the website are the Entrant's responsibility and are dependent on the internet service provider used.

7. Technical Problems:

  1. To the extent permitted by law, the Promoter excludes liability for any problems or technical malfunction when downloading any materials in this Competition.

8. Prizes:

  1. The total prize pool for the individual winners are valued at a maximum of AUD $720 RRP (includes GST and Postage & Handling via Australia Post (P&H)).
  2. The prize pool includes the following prizes:
       i.   First Prize - Total Value AUD$440 RRP
    4 x 10kg Buckets of Mega Horse Supplement.
       ii.   Second Prize - Total Value AUD$160 RRP
    2 x 10kg Buckets of Mega Horse Supplement.
       iii.   Third Prize - Total Value AUD$120 RRP
    1 x Mega Horse Halter & Lead Set .
  3. Subject to State and Territory regulations, the promoter is not responsible or liable for any change in the value of the prize occurring between 13th December 2008 and the date on which the prize is claimed.
  4. The prizes are not transferable, exchangeable or redeemable for cash.
  5. In the event that any prize is unavailable, the promoter reserves the right to substitute a prize of equal or greater value.
  6. For each prize stated in 8.b.i, 8.b.ii, & 8.b.iii above, the authorised Stockist noted on the Entry Form will receive the same prizes as the winner for either their own personal use or for sale in their store at Recommended Retail Price.

9. Draw:

  1. The Draw will begin from 4pm on Saturday, 11th April, 2009 at the East Moreton Branch Inc. of Australian Stock Horse Association Futurity and Championship Show at the Woodford Showgrounds, Neurum Road, Woodford, Qld, 4514.
  2. All entries will be placed in a barrel or similar vessel; the judge will draw 1 name at random for each of the three (3) prizes stipulated and will announce both winner’s name and their authorised Stockist.
  3. The judge's decision is final and no correspondence will be entered into.

10. Notification:

  1. Only official winners of the Draw will be notified by telephone and email the first business day after the Draw.
  2. The name and suburb of each winner of the Draw will be published on the Mega Horse website (www.MegaHorse.net.au) and in "The Australian" Newspaper on 15th April, 2009.

11. Prize Collection:

  1. The Promoter will, when notifying winners, make arrangements with each winner for the delivery or collection of their prizes.
  2. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy the competition conditions or forfeiting or not claiming a prize.
  3. Any prize that remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a re-draw at 289 Crabbes Creek Road, Crabbes Creek, NSW, 2483 within 30 days of the original draw.
  4. Any re-draw winner/s will be notified by phone and email on the day of the re-draw.

12. Cancellation:

  1. If for any reason this Competition is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right, subject to any written directions given by the NSW Office of Liquor, Gaming and Racing, to cancel, postpone or amend the Competition without compensation to any Entrant.

13. Disqualification:

  1. Any breach of these Terms disentitles an Entrant from participating in the Competition and winning any prizes.
  2. The Promoter reserves the right in its sole discretion to disqualify any Entrant or Stockist who the Promoter has reason to believe has breached any of these Terms or any instructions or directions on the Website, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition.
  3. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

14. Personal Information:

  1. The Promoter collects the personal information of Entrants in order to conduct the Competition.
  2. By entering the Competition and selecting the option to receive further information from the Promoter regarding future promotions, each Entrant agrees that the Promoter may use this information for future similar promotional, marketing and publicity purposes, including sending the Entrant electronic messages.
  3. An Entrant's personal information may be disclosed to the NSW Office of Liquor, Gaming and Racing and winners' names published as required under the relevant lottery legislation.
  4. All personal details of Entrants will be collected and stored by the Promoter.
  5. Entrants' personal information may be used for future promotional, marketing and publicity activities of the Promoter but will not be provided to other 3rd party organisations.
  6. To access, update or correct your personal information, please contact the Promoter directly on (02) 6677 1197.

15. Limitation of Liability:

  1. The Promoter shall not be liable for any loss or damages (including but not limited to indirect or consequential loss), or for personal injury or death or loss of, or damage to property, which is suffered or sustained in connection with the Competition or any prize, except to the extent that liability cannot be excluded by law.
  2. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Competition if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation technical malfunctions or failures.
